Terms of Use for OctoDash

1. Acceptance of Terms

By downloading, installing, or using OctoDash ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

OctoDash is developed and operated by Kevin M ("we", "our", or "us"), trading as OctoDash. The App is not affiliated with or endorsed by Octopus Energy Ltd.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable licence to use OctoDash on your personal device for your own personal, non-commercial purposes, subject to these Terms.

You may not:

• Copy, modify, or distribute the App or its content
• Reverse-engineer or attempt to extract the source code
• Use the App for any unlawful or harmful purpose
• Attempt to gain unauthorised access to any part of the App or connected systems

3. In-App Purchases & Subscriptions

Remove Ads (One-Time Purchase)

• Product: Remove Ads — permanently removes advertisements from OctoDash
• Price: £0.99 (one-time payment)
• Billing: Charged once via your App Store or Google Play account
• Refunds: Managed by Apple App Store or Google Play per their refund policies

OctoDash PRO (Auto-Renewing Subscription)

• Product: OctoDash PRO — unlocks advanced features including unlimited price alerts, webhook integration, smart home automation, alert history, and 7-day price predictions
• Price: £2.39 per month (price may vary by region; the exact price is shown before purchase)
• Billing cycle: Monthly, automatically renewing
• Free trial: Not currently offered
• Renewal: Your subscription automatically renews each month unless cancelled at least 24 hours before the end of the current billing period
• Cancellation: You may cancel at any time via your App Store or Google Play account settings. Access continues until the end of the paid period
• Price changes: We will notify you of any price changes in advance. Continued use after the change takes effect constitutes acceptance
• Refunds: Managed by Apple App Store or Google Play per their refund policies

4. Third-Party Services

OctoDash connects to third-party services to provide its features. Your use of these services is subject to their respective terms:

• Octopus Energy API: Used to fetch tariff rates and usage data. Requires your Octopus Energy API key. Subject to Octopus Energy's Terms.
• Guy Lipman Forecast API: Used to provide supplementary price forecasts. Subject to Guy Lipman's terms.
• AgilePredict: Used to provide supplementary price predictions. Subject to AgilePredict's terms.
• Google AdMob (free users): Serves advertisements. Subject to Google's Terms of Service.
• Webhook services (Pro users): If you configure webhooks (e.g. IFTTT, Zapier, Home Assistant), OctoDash sends price alert data to your specified URLs. Subject to the terms of those services.

We are not responsible for the availability, accuracy, or content of any third-party service.

5. Disclaimer of Warranties

OctoDash is a personal hobby project provided for general informational and utility purposes only.

In particular, we do not warrant that:

• Price data, forecasts, or predictions are accurate or up-to-date
• The App will be available at all times
• Webhook notifications will be delivered reliably
• The App will function correctly on all devices or operating system versions

6. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of data, revenue, savings, or profits, arising from or related to your use of (or inability to use) OctoDash, including errors, outages, delays, missing data, tariff or pricing inaccuracies, webhook failures, or third-party service issues.

You are solely responsible for how you use the App and for any decisions or actions you take based on App content, calculations, alerts, or third-party data.

7. Acceptable Use

You agree not to use OctoDash to:

• Violate any applicable law or regulation
• Attempt to overload or disrupt Octopus Energy's API or any other third-party service
• Share your API key or account credentials with others in a way that violates Octopus Energy's Terms of Service
• Use the App in any way that could harm us, our users, or third parties

8. Intellectual Property

All content, design, and code within OctoDash (excluding third-party libraries and data) is owned by or licensed to us. The OctoDash name and branding are not affiliated with or endorsed by Octopus Energy Ltd.

"Octopus Energy" is a registered trademark of Octopus Energy Ltd. OctoDash is an independent third-party app and has no formal relationship with Octopus Energy Ltd.

9. Privacy

Your use of OctoDash is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

11. Termination

We reserve the right to suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time by uninstalling it from your device.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
